CueDeck terms

Introduction

These Terms of Use apply to CueDeck, an iPhone camera and content-creation application operated by Andrew White trading as Before Anywhere.

By downloading or using CueDeck, you agree to these Terms together with any applicable terms of the platform through which you obtained the app.

If you do not agree to these Terms, you should not use CueDeck.

CueDeck is a product of Before Anywhere.

App Store licence

CueDeck is distributed through Apple's App Store.

Your licence to use the CueDeck application is subject to Apple's applicable App Store terms and Apple's Standard Licensed Application End User License Agreement where that agreement applies.

These Terms supplement those terms by explaining additional conditions relating specifically to CueDeck and Before Anywhere.

Nothing in these Terms is intended to replace or conflict with any mandatory terms that apply through Apple's App Store.

Using CueDeck

CueDeck is designed to help you capture, create, review, edit and export supported photo and video content on compatible Apple devices.

You may use CueDeck for lawful personal, creative or commercial purposes.

You must not use CueDeck:

• in violation of applicable law;
• to infringe another person's intellectual property, privacy or other legal rights;
• to record people where recording is prohibited by law;
• to access or attempt to interfere with CueDeck's software or security in an unauthorised manner; or
• for any purpose that would require Before Anywhere to provide functionality that CueDeck does not claim to provide.

You are responsible for how you use CueDeck and for content you create using it.

Recording other people

Camera and microphone laws vary between countries, regions and situations.

You are responsible for ensuring that you have any permission, consent or other lawful basis required before photographing, filming or recording another person.

CueDeck does not determine whether a particular recording is lawful.

Please respect the privacy, safety and rights of the people around you.

Your content

You retain ownership of photos, videos, recordings and other original content that you create using CueDeck.

Before Anywhere does not claim ownership of your CueDeck productions merely because they were created or edited using the app.

CueDeck is designed to store productions locally on your device unless you choose to export or share them.

If you choose to share content with another person, app, platform or service, your use of that destination is subject to its own terms and policies.

You are responsible for ensuring that you have the rights necessary to create, edit, export and share your content.

CueDeck and Before Anywhere intellectual property

CueDeck, Before Anywhere, their software, interface designs, branding, graphics, logos, artwork, documentation and other original product materials are protected by applicable intellectual-property laws.

Except for the rights granted to you under the applicable App Store licence and applicable law, no ownership rights in CueDeck or Before Anywhere are transferred to you.

You must not copy, redistribute, modify, reverse engineer or create derivative works from CueDeck except where applicable law expressly permits you to do so despite this restriction.

Nothing in these Terms restricts rights that cannot lawfully be restricted.

Device and feature compatibility

CueDeck depends on Apple hardware, iOS, camera capabilities, permissions and system frameworks.

Not every CueDeck feature will necessarily be available on every iPhone model, iOS version or hardware configuration.

Some features may require access to your Camera, Microphone, Photos or Speech Recognition.

If a required permission is disabled, the relevant feature may not work.

Before Anywhere may change device or operating-system requirements as CueDeck develops.

Voice Director

CueDeck may provide Voice Director or other voice-controlled features on compatible devices.

Voice commands are provided as a convenience and may not recognise every command correctly in every environment.

You remain responsible for checking that CueDeck is performing the recording or camera action you intend.

Touch controls remain available where provided by the app.

Do not rely on Voice Director where failure to recognise a command could create a safety risk or cause serious loss.

Capture and recording

Camera applications depend on hardware, storage availability, operating-system services and other technical conditions.

You should check important recordings during or after capture where reasonably possible.

For recordings that are particularly important, you should consider appropriate backup or alternative recording arrangements.

Before Anywhere does not promise that every recording attempt will be uninterrupted or that every file can be recovered following device failure, storage failure, operating-system failure, accidental deletion or circumstances outside CueDeck's reasonable control.

Nothing in this section excludes responsibility that cannot legally be excluded.

Storage, exports and backups

CueDeck productions may remain in CueDeck's local app storage until you delete them or delete the app.

Content exported to Apple's Photos library or another destination becomes a separate copy.

You are responsible for maintaining copies or backups of content that is important to you.

Deleting CueDeck or deleting a CueDeck production may permanently remove locally stored production material.

Deleting CueDeck does not necessarily remove media that you previously saved separately to Photos or another service.

Purchases

CueDeck may be offered as a paid application through Apple's App Store.

The price shown by Apple for your storefront at the time of purchase is the applicable purchase price.

Payments, billing, refunds, purchase records and applicable taxes handled through the App Store are subject to Apple's applicable terms and processes.

Before Anywhere does not receive your payment-card details from CueDeck.

Nothing in these Terms limits any statutory rights you may have in relation to digital content or purchases.

Updates and changes to CueDeck

CueDeck may be updated over time to improve reliability, compatibility, security, design or functionality.

Features may be added, changed or removed where reasonably necessary as the product develops.

Changes to Apple hardware, iOS or system frameworks may also affect how CueDeck operates.

We do not guarantee that every historical feature or configuration will remain available indefinitely.

Where applicable law gives you rights in relation to changes to digital content, those rights are not affected by these Terms.

Availability

We aim to keep CueDeck reliable and available, but we do not guarantee uninterrupted or error-free operation.

CueDeck may occasionally be unavailable or affected by:

• device limitations;
• insufficient storage;
• iOS behaviour;
• Apple services or frameworks;
• software bugs;
• maintenance;
• compatibility changes; or
• circumstances outside our reasonable control.

We may suspend or discontinue CueDeck or particular features where reasonably necessary, subject to applicable consumer law.

Third-party services

CueDeck may interact with Apple services and system features such as the App Store, Photos, iOS sharing, Speech Recognition and other Apple frameworks.

If you choose to export or share content to another app, website or service, that third party is responsible for its own service.

Before Anywhere is not responsible for third-party services that we do not operate or control.

This does not affect any responsibility we have under applicable law.

Privacy

Your privacy is important to CueDeck.

Our Privacy Policy explains how CueDeck accesses and handles information and how Before Anywhere handles information that you provide directly to us.

The Privacy Policy forms part of the information governing your use of CueDeck.

When contacting support, please provide only information reasonably necessary for us to understand your enquiry.

Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

If you are a consumer, you retain all mandatory rights and remedies provided by applicable consumer law.

CueDeck is a creative camera and content-creation tool. It is not designed for emergency, medical, safety-critical, evidential or other use where failure of a recording or command could reasonably result in death, personal injury or serious harm.

To the extent permitted by applicable law, Before Anywhere is not responsible for losses caused by circumstances outside our reasonable control or by use of CueDeck in a way that is unlawful, contrary to these Terms, or outside the purposes for which the app is provided.

We do not seek to exclude responsibility for losses where applicable law says we are responsible.

International use

CueDeck is intended to be available in multiple countries and regions.

You are responsible for complying with laws that apply to your use of camera, microphone, recording and content-sharing features where you are located.

Certain features, services or App Store arrangements may vary by country or region.

Nothing in these Terms removes mandatory legal protections that apply to you in your country of residence.

Termination

You may stop using CueDeck at any time and may remove the app from your device.

Your rights to use CueDeck may end if you materially breach applicable licence terms or these Terms, subject to applicable law.

Terms which by their nature should continue after you stop using CueDeck — including provisions concerning intellectual property, your content, responsibility and applicable legal rights — may continue to apply.

Changes to these Terms

We may update these Terms when CueDeck changes, our business changes, or legal or regulatory requirements change.

The latest version will be published on this page with an updated date.

Where required by applicable law, we will take appropriate steps to notify users of material changes.

Governing law

These Terms are governed by the laws of England and Wales, except where the mandatory law of your country or region gives you rights to rely on another applicable law.

If you are a consumer, nothing in this section deprives you of mandatory protections or rights available to you under the law that applies to you.

Any dispute may be brought before a court that has jurisdiction under applicable law.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.
